Abstract
A dissertação analisa a estrutura, os processos e os desafios enfrentados pela Universidade do Estado do Amazonas (UEA) no setor de compras públicas, à luz da nova Lei de Licitações e Contratos nº 14.133/2021. O trabalho tem como objetivo principal caracterizar o funcionamento da área de compras da UEA, verificando como a nova legislação impacta a gestão, a eficiência e a transparência das aquisições realizadas pela instituição. A pesquisa adotou abordagem qualitativa e quantitativa, com base em levantamento de dados do sistema E-compras do Estado do Amazonas, análise documental e entrevistas com servidores do setor de compras da universidade. Foram analisadas as modalidades de licitação utilizadas entre 2019 e 2024, bem como os materiais adquiridos, com destaque para microcomputadores, cadeiras, mesas de escritório e armários de ferro. Os resultados apontam uma predominância da modalidade pregão eletrônico a partir de 2021, em substituição gradual à dispensa de licitação, muito utilizada em 2020 devido à pandemia da COVID-19. Também foi identificada uma concentração de investimentos em equipamentos para faculdades como a EST (Escola Superior de Tecnologia) e a ESO (Escola Superior de Ciências Sociais), refletindo o crescimento de projetos de pesquisa e inovação tecnológica. A dissertação evidencia a necessidade de planejamento estratégico nas compras públicas da UEA, com foco em eficiência, transparência e racionalidade. A Lei 14.133/2021 é analisada como um instrumento de aprimoramento, ao trazer inovações como a promoção de compras sustentáveis e tecnológicas, a elaboração de um Plano Anual de Contratações e de Estudos Técnicos Preliminares (ETP), reforçando a importância do planejamento estratégico antes da contratação, o que visa reduzir desperdícios e aquisições mal fundamentadas. Conclui-se que, apesar dos avanços legais, a UEA ainda enfrenta desafios relacionados à capacitação técnica, planejamento de demandas e integração dos sistemas, sendo necessário fortalecer práticas de governança e controle interno para que as compras públicas contribuam efetivamente para o desenvolvimento da instituição. The dissertation analyzes the structure, processes, and challenges faced by the State University of Amazonas (UEA) in the area of public procurement, in light of the new Law on Public Procurement and Contracts No. 14,133/2021. The main objective of the work is to characterize the functioning of UEA’s procurement sector, examining how the new legislation impacts the management, efficiency, and transparency of acquisitions made by the institution. The research adopts a qualitative and quantitative approach, based on data collection from the Amazonas State E- procurement system, document analysis, and interviews with procurement staff at the university. The study analyzed the procurement modalities used between 2019 and 2024, as well as the items acquired, with emphasis on desktop computers, chairs, office desks, and metal cabinets. The results indicate a predominance of the electronic bidding modality from 2021 onwards, gradually replacing direct procurement (dispensa de licitação), which was widely used in 2020 due to the COVID-19 pandemic. There was also a concentration of investments in equipment for faculties such as the School of Technology (EST) and the School of Social Sciences (ESO), reflecting the growth of research and technological innovation projects. The dissertation highlights the need for strategic planning in UEA’s public procurement processes, focusing on efficiency, transparency, and rationality. Law No. 14,133/2021 is analyzed as an instrument of improvement, introducing innovations such as the promotion of sustainable and technological procurement, the development of an Annual Procurement Plan and Preliminary Technical Studies (ETP), reinforcing the importance of planning before contracting, aimed at reducing waste and poorly supported acquisitions. The study concludes that, despite legal advances, UEA still faces challenges related to technical training, demand planning, and system integration, making it necessary to strengthen governance practices and internal controls so that public procurement can effectively contribute to the institution's development.
