O novo estatuto do trabalho: em prol de uma luta perdida?

Abstract

Esta dissertação se insere no campo da Administração Pública. Em particular, observa-se os discursos de legitimação do Anteprojeto do Estatuto do Trabalho, agenda governamental instituída para tecer o contraponto à Reforma Trabalhista aprovada em julho de 2017. Procura compreender os usos estratégicos de narrativas e discursos, considerando que a legitimação depende da expansão do escopo do conflito e está sujeita a estratégias de deslegitimação. Assim, a questão que move essa dissertação é: quais estratégias de legitimação e deslegitimação estão subjacentes aos discursos contra hegemônicos das audiências públicas do Anteprojeto do Estatuto do Trabalho? Para responder à questão formulada, o objetivo da pesquisa é compreender como as estratégias de legitimação e deslegitimação influenciam o escopo do conflito. A pesquisa adota uma metodologia interpretativista, utilizando o Quadro Político Narrativo associado à Análise Qualitativa de Conteúdo, além da metodologia de análise crítica do discurso, com abordagem sociocognitiva. O corpus de análise é constituído pelas audiências públicas do Estatuto do Trabalho. Inicialmente, foram abordadas as estratégias narrativas para conferir sentidos e significados aos problemas apresentados. Os resultados indicam prevalência de significados de dissenso em relação à Reforma Trabalhista associados aos custos do retrocesso de direitos trabalhistas. Em seguida, foi investigado o processamento dos discursos, para desvelar processos de persuasão e manipulação, decorrentes, respectivamente, do uso do poder legítimo e ilegítimo. Foram identificados processos persuasivos em discursos contra hegemônicos e processos manipulativos no discurso hegemônico. Conclui-se que as estratégias narrativas identificadas nas audiências públicas do Anteprojeto do Estatuto do Trabalho decorrem de processos discursivos persuasivos e legítimos, que são obstaculizadas pela manipulação discursiva ilegítima do discurso hegemônico, influenciando negativamente a expansão do escopo do conflito. A dissertação evidencia a importância dessa compreensão para transpor a contenção do debate público, imposta por grupos hegemônicos que possuem acesso privilegiado a recursos simbólicos. In particular, it observes the legitimizing discourses surrounding the Preliminary Draft of the Labor Statute, a governmental agenda instituted to provide the counterpoint to the Labor Reform approved in July 2017. The dissertation seeks to understand the strategic uses of narratives and discourses in the legitimizing processes, considering that these processes depend on expanding the conflict scope and are subject to delegitimization strategies. Thus, the central question of this dissertation is: what legitimization and delegitimization strategies are subjacentes to the counter- hegemonic discourses of the public hearings of the Preliminary Draft of the Labor Statute? To answer the formulated question, the research objective is to understand how legitimation and delegitimization strategies influence the scope of the conflict. The research adopts an interpretivist methodology, utilizing the Narrative Political Framework associated with Qualitative Content Analysis and the critical discourse analysis methodology, using a sociocognitive approach. The analysis corpus is constituted by the public hearings of the Labor Statute. Initially, the narrative strategies employed to assign meanings to the issues presented were addressed. The results indicate the prevalence of meanings of dissent to concerning Labor Reform and the costs of the retrocession of labor rights. Next, the processing of the discourses was investigated to uncover processes of persuasion and manipulation, arising, respectively, from the use of legitimate and illegitimate power. Persuasive processes were identified in counter-hegemonic discourses, and manipulative processes were present in hegemonic discourse. It is concluded that the narrative strategies identified in the public hearings on the Preliminary Draft of the Labor Statute arise from persuasive and legitimate discursive processes, which are hindered by the illegitimate discursive manipulation of the hegemonic discourse, negatively influencing the conflict scope expansion. The dissertation highlights the importance of this understanding for transporting the content of public debate, imposed by hegemonic groups, considering that these groups have privileged access to symbolic resources.
