A análise da transmissibilidade causa mortis dos bens digitais personalíssimos e híbridos da pessoa natural tendências contemporâneas

Abstract

A pesquisa analisou a transmissibilidade causa mortis dos bens digitais personalíssimos e híbridos de uma pessoa natural, buscando entender se esses bens, que refletem aspectos da personalidade do falecido, podem ser transmitidos aos herdeiros. A questão central era se a morte extingue a personalidade jurídica e, consequentemente, o direito dos herdeiros de gerir as memórias digitais do falecido. A pesquisa qualitativa envolveu análise bibliográfica e documental, incluindo julgamentos do TJMG e TJSP, além de projetos legislativos em tramitação. O estudo revelou tendências interpretativas, destacando a importância de considerar a manifestação de última vontade do falecido, seja por meios tradicionais ou digitais. O principal ponto de divergência identificado foi entre preservar o sigilo dos bens digitais personalíssimos ou garantiro acesso dos herdeiros às memórias digitais do falecido.The research analyzed the transmissibility causa mortis of personal and hybrid digital assets of a natural person, aiming to understand whether these assets, which reflect aspects of the deceased's personality, can be transmitted to their heirs. The central question was whether death extinguishes legal personality and, consequently, the heirs' right to manage the deceased’s digital memories. The qualitative researchinvolved bibliographic and documentary analysis, including rulings from the TJMG and TJSP, as well as legislative projects under consideration. The study revealed interpretative trends, highlighting the importance of considering the deceased's last will, whether expressed through traditional or digital means. The main point of divergence identified was between preserving the confidentiality of the deceased's personal digital assets or granting the heirs' access to the deceased's digital memories.
