Abstract
Realiza-se uma análise do Estado Democrático de Direito em duas perspectivas: a ética e a financeira. Entendendo por Estado ético aquele que se compromete a realizar os direitos fundamentais, tanto em conotação das liberdades individuais quanto das responsabilidades coletivas de bem-estar social; e entendendo por Estado financeiro aquele que se preocupa com o equilíbrio das contas públicas e da remuneração do capital privado. Demonstra-se, por meio de uma análise no Novo Regime Fiscal que a opção por um ou por outro Estado não é neutra e que se há pretensão de resolver a crise econômica e social é preciso a predileção do Estado ético sobre o Estado financeiro.
An analysis of the Democratic State of Law is carried out in two perspectives: ethics and finance. Understanding by ethical State the one that undertakes to realize the fundamental rights, as much in connotation of the individual liberties as of the collective responsibilities of social welfare; and the financial state is understood to be one that is concerned with the balance of public accounts and the remuneration of private capital. It is demonstrated, through an analysis in the New Fiscal Regime that the option for one or the other State is not neutral and that if it is pretended to solve the economic and social crisis, the predilection of the ethical State over the financial state is necessary.
