Pesquisa bibliográfica e documental, realizada na literatura médica e jurídica internacional e nacional. Investiga a validade da construção de bases dogmáticas e jurídicas do tema, com enfoque no direito brasileiro. Aborda as diretivas antecipadas de vontade como legítimo exercício da autonomia privada do paciente, diante da terminalidade da vida.Bibliographical and documentary research, carried out in the medical and legal literature using international and national data. It investigates the validity of the construction of dogmatic and legal bases of the subject, focusing on Brazilian law. It also addresses the advance directives as the legitimate exercise of the patient’s private autonomy, facing the termination of life.
