Aquisição de imóveis por estrangeiros no Brasil

Abstract

A legislação brasileira impõe limitações à aquisição de imóveis por estrangeiros, de forma que ao adquirirem propriedade no território pátrio estes devem observar um procedimento diferenciado e certas restrições quanto a localização e extensão do imóvel. Logo, é oportuno analisar quais são as limitações impostas, qual a legislação que se aplica, o teor dos pareceres emitidos pela Advocacia Geral da União sobre o assunto nos últimos anos e os motivos que levaram o Estado brasileiro a determinar tais restrições.

The Brazilian law imposes limitations on the acquisition of properties by foreigners, once when they acquire property in the homeland, must follow a different procedure and certain restrictions about the location and the extension of the property. Therefore, it is appropriate to analyze the imposed limitations, what law is applied, the content of the opinions issued by the Attorney General concerning the issue in recent years and the reasons that led the Brazilian government to establish such restrictions.
