Os direitos fundamentais frente às biografias não autorizadas: liberdade de imprensa versus direitos de intimidade e privacidade

Abstract

Em recente problemática, pretende-se solucionar o aparente conflito de direitos fundamentais entre a liberdade de expressão e acesso à informação em face da proteção dos direitos individuais como a intimidade e a privacidade, especificamente no que concerne à divulgação de obras biográficas sem a prévia autorização do biografado. Numa pesquisa bibliográfica exploratória, analisa-se a hipótese de conciliação dos interesses público e privado, de modo a viabilizar a produção e circulação das biografias sem qualquer tipo de censura, havendo controle judicial apenas posteriormente, na tutela dos direitos da personalidade.

In the recent set of problems, we intend to solve the assumed conflict of fundamental rights between freedom of expression and access to information in the light of the protection of individual rights such as intimacy and privacy, specifically regarding to the release of biographies without prior authorization of the biographee. In an exploratory bibliographical research, we analyze the hypothesis of conciliation of public and private interests in order to enable the production and circulation of biographies without any kind of censorship, only with later judicial control, in the protection of personal rights.
