“Desbravando a mina”: regulação e capacidades estatais na implementação da política mineral brasileira

Abstract

Este estudo buscou analisar a qualidade da burocracia que integra as agências reguladoras brasileiras, bem como identificar as capacidades do governo federal para centralizar o papel de regular as atividades minerárias, bem como coordenar e implementar as políticas minerais, por meio da Agência Nacional de Mineração (ANM). Assim, dois estudos independentes, porém, complementares, foram desenvolvidos. No primeiro, analisou-se as características da regulocracia federal brasileira, criando-se um índice para medir a sua qualidade. Os resultados indicaram que a qualidade da regulocracia é alta, no geral, porém, quando o índice é desagregado em suas dimensões, algumas agências apresentam melhores indicadores que outras. A agência reguladora que mais se afasta das demais, em termos de menor qualidade, é a ANM. No segundo estudo, ao analisar os fatores que contribuíram para o processo de transformação do Departamento Nacional de Produção Mineral (DNPM) na ANM, verificou- se que a despeito de ela ter sido baseada na proposta de possibilitar a construção de novas capacidades, a ANM assumiu as velhas heranças do DNPM. Ao sintetizar as capacidades analíticas, gerenciais e políticas da ANM, associadas aos recursos e processos, em seus níveis individuais, operacionais e sistêmicos, os resultados indicaram que o déficit de recursos humanos e orçamentário pelo qual passava o DNPM também é a realidade da agência. No geral, os resultados da pesquisa sugerem que a especialização na produção mineral parece enfraquecer o poder do Estado brasileiro em regular a atividade, pois as rendas geradas pela atividade contribuem para que os governantes as utilizem com o objetivo de se perpetuar no poder, aplicando-os em áreas que lhe dão maior retorno político. Por outro lado, o órgão regulador permanece sem a atenção devida, o que incapacita os seus líderes de formularem e implementarem políticas adequadas e a agência de entregar serviços de qualidade, favorecendo a falta de apoio público e político. Em termos de avanços teóricos, esta pesquisa demonstra que a análise das capacidades regulatórias do governo federal brasileiro, sob a ótica do modelo teórico desenvolvido por Wu, Ramesh e Howlett (2015) e incrementado por Chenboonthai e Watanabe (2018), pode ser aplicada na compreensão da regulação do setor mineral. This study sought to analyze the quality of the bureaucracy that integrates the Brazilian regulatory agencies, as well as to identify the capabilities of the federal government to centralize the role of regulating mining activities, as well as to coordinate and implement mineral policies, through the National Mining Agency (Agência Nacional de Mineração). ANM). Thus, two independent but complementary studies were developed. In the first, the characteristics of the Brazilian federal regulation were analyzed, creating an index to measure its quality. The results indicated that the quality of the regulation is high in general, however, when the index is disaggregated into its dimensions, some agencies present better indicators than others. The regulatory agency that most differs from the others, in terms of lower quality, is the ANM. In the second study, when analyzing the factors that contributed to the process of transforming the National Department of Mineral Production (DNPM) into the ANM, it was found that, despite the fact that it was based on the proposal to enable the construction of new capacities, the ANM assumed the old legacies of the DNPM. By synthesizing ANM's analytical, managerial and political capabilities, associated with resources and processes, at their individual, operational and systemic levels, the results indicated that the deficit in human and budgetary resources experienced by the DNPM is also the agency's reality. In general, the results of the research suggest that specialization in mineral production seems to weaken the power of the Brazilian State to regulate the activity, since the income generated by the activity contributes for the rulers to use it with the objective of perpetuating itself in power, applying it those in areas that give you greater political return. On the other hand, the regulatory body remains without due attention, which incapacitates its leaders to formulate and implement adequate policies and the agency to deliver quality services, favoring the lack of public and political support. In terms of theoretical advances, this study demonstrates that the analysis of the regulatory capacities of the Brazilian federal government, from the perspective of the theoretical model developed by Wu, Ramesh and Howlett (2015) and enhanced by Chenboonthai and Watanabe (2018), can be applied in the understanding of the regulation of the mineral sector.
