Abstract
O presente trabalho visa investigar a relação entre a uniformização do Direito Internacional de Compra e Venda e as novas tecnologias, destacando-se aplicação da Convenção das Nações Unidas sobre Contratos de Compra e Venda Internacional de Mercadorias (CISG), instrumento que entrou em vigor no Brasil em 2014, em conjunto com a Convenção das Nações Unidas sobre o Uso das Comunicações Eletrônicas em Contratos Internacionais (CUEIC), instrumento que ainda não foi aderido pelo Brasil, mas já se encontra em vigor internacionalmente. Será também realizada uma analise crítica da convenção sobre o uso de comunicações eletrônicas, ressaltando-se outros meios de normatização da matéria de contratos ele- trônicos internacionais, e perquirindo assim sobre a necessidade de adesão da CUECIC pelo Brasil.
This paper aims to investigate the relationship between the standardization of the International Commercial Law and new technologies, with emphasis on the implementation of the United Nations Convention on Contracts for the International Sale of Goods (CISG), an instrument that came into effect in Brazil in 2014, together with the United Nations Convention on the Use of Electronic Communications in International Contracts (ECC), an instrument that has not been adopted by Brazil, but has already came into force internationally. It will also be held a critical analysis of the Convention on the use of electronic communications, highlighting other means of standardization on the field of international electronic contracts, and so inquiring about the need of adoption of ECC by Brazil.
