Resumo
Esta dissertação analisa as consequências da judicialização da saúde no Brasil, com foco na responsabilidade solidária dos entes federados – União, Estados, Municípios e Distrito Federal – no fornecimento de medicamentos. A pesquisa se baseia na Teoria Geral do Federalismo e na Teoria da Justiça, abordando a repartição constitucional de competências e o impacto socioeconômico das decisões judiciais que obrigam o poder público a custear tratamentos. O estudo avalia 210 acórdãos do Supremo Tribunal Federal (STF), julgados entre 2020 e 2023, período marcado pela pandemia de COVID-19 e as implicações no sistema de saúde. Os resultados apontam que a maioria das demandas decorre da ausência de medicamentos na lista do Sistema Único de Saúde (SUS) e da disputa entre os entes federativos sobre a responsabilidade pelo custeio. O trabalho destaca os desafios da descentralização federativa e do federalismo cooperativo, evidenciando a sobrecarga dos Estados e Municípios e os impactos financeiros sobre o orçamento público. Conclui-se que, embora a judicialização seja um instrumento importante para garantir o direito à saúde, ela também revela fragilidades na gestão pública e na formulação de políticas de saúde, afetando a equidade no acesso aos serviços e medicamentos. This dissertation analyzes the consequences of the judicialization of healthcare in Brazil, focusing on the joint liability of federal entities – the Union, States, and Municipalities – in the provision of medications. The research is based on the General Theory of Federalism and the Theory of Justice, addressing the constitutional distribution of competencies and the socioeconomic impact of judicial decisions that require the government to fund treatments. The study examines 210 rulings from the Supreme Federal Court (STF), issued between 2020 and 2023, a period marked by the COVID-19 pandemic and its implications for the healthcare system. The findings indicate that most claims arise from the absence of medications on the Unified Health System (SUS) list and disputes among federal entities over funding responsibilities. The study highlights the challenges of federal decentralization and cooperative federalism, revealing the burden placed on States and Municipalities and the financial impacts on public budgets. It concludes that, while judicialization is an essential tool for ensuring the right to health, it also exposes weaknesses in public management and health policy formulation, affecting equity in access to services and medications.
