Legislação urbanística e produção do espaço urbano: um estudo de caso sobre Cataguases/MG, no período de 2006 a 2022

Abstract

O presente trabalho trata da relação do planejamento e da gestão urbano-territorial e a produção do espaço urbano, por meio da atuação dos agentes sociais, a partir da correlação entre os novos parcelamentos urbanos e a legislação urbanística no município Cataguases-MG, no período de 2006 e 2022. Ainda são escassas as pesquisas que abordam temas como produção e planejamento do espaço urbano em cidades de pequeno e médio porte, em contrapartida, muitos são os desafios que essas cidades enfrentam. No caso de Cataguases, devido a sua importância no cenário cultural regional, as pesquisas científicas encontradas são voltadas, em sua maioria, para questões envolvendo patrimônio histórico cultural, cinema, literatura, dentre outros. Buscou-se, portanto, a partir desta investigação, ampliar o olhar sobre os estudos urbanos da cidade, que se inicia com a data de aprovação do Plano Diretor municipal. A escolha deste recorte temporal justifica-se pela identificação de leis urbanísticas em vigor que se encontram obsoletas. Parte-se, portanto, de uma contextualização histórica da formação urbana e, posteriormente, analisa-se o quadro legal a respeito do ordenamento urbano, com foco na atuação do Poder Público municipal, enquanto ente regulador e responsável pela gestão urbana. Adiante, realiza-se um mapeamento e análise da produção do espaço urbano de Cataguases, a partir dos loteamentos aprovados no recorte temporal proposto, com a identificação dos promotores imobiliários e suas práticas. A pesquisa revela que meio aos desafios da gestão urbana local e leis obsoletas, a cidade cresce no ritmo das demandas do setor imobiliário, sob a ilusão do desenvolvimento econômico, sem qualquer reflexão sobre os resultados do modelo que se tem adotado de desenvolvimento urbano. Essa lógica tem levado a cidade a crescer mais territorialmente (expansão horizontal) do que demograficamente. Palavras-chave: Planejamento Urbano em pequenas cidades. Produção do Espaço Urbano. Cataguases/MG.This work is about the relationship between urban-territorial planning and management and the production of urban space, through the actions of social agents, based on the correlation between new urban subdivisions and urban planning legislation in the municipality of Cataguases-MG, in the period 2006 and 2022. Research that addresses topics such as production and planning of urban space in small and medium-sized cities is still scarce. On the other hand, there are many challenges that these cities face. In the case of Cataguases, due to its importance in the regional cultural scene, the scientific research found is mostly focused on issues involving cultural historical heritage, cinema, literature, among others. Therefore, based on this investigation, we sought to broaden our perspective on urban studies in the city, which begins with the date of approval of the municipal Master Plan. The choice of this time frame is justified by the identification of current urban planning laws that are obsolete. It therefore starts with a historical contextualization of urban formation and, subsequently, analyzes the legal framework regarding urban planning, focusing on the role of the municipal Public Power, as a regulatory entity responsible for urban management. Further on, a mapping and analysis of the production of the urban space of Cataguases is carried out, based on the subdivisions approved in the proposed time frame, with the identification of real estate developers and their practices. The research reveals that amid the challenges of local urban management and obsolete laws, the city grows at the pace of the demands of the real estate sector, under the illusion of economic development, without any reflection on the results of the model that has been adopted for urban development. This logic has led the city to grow more territorially (horizontal expansion) than demographically. Keywords: Urban Planning in small cities. Production of Urban Space. Urban management.
