A culpa mortuária: uma tentativa de interpretação para o retrocesso do art. 1830 do Código Civil brasileiro

Abstract

Com o advento da Constituição da República de 1988, instituiu-se, no Brasil, o Estado Democrático de Direito. A CR/88 disciplina novos preceitos sobre a família e estabelece como fundamento a Dignidade da Pessoa Humana. Em que pese esta nova realidade legislativa e estatal, o legislador de 2002, no que se refere à dissolução do casamento, no direito de família, manteve a necessidade de discussão de culpa, assunto que vem sendo aos poucos superado pela jurisprudência. Há uma tendência de desconsideração da culpa na separação judicial. No entanto, no art. 1830 do CC/02, o legislador inovou: foi trazida uma presunção de culpa em desfavor do falecido, quando o cônjuge falecido estava separado de fato há mais de dois anos, hipótese em que o cônjuge sobrevivente torna-se herdeiro. Buscou-se, neste artigo, aclarar as razões do retrocesso de se ter trazido a culpa mortuária para o Direito Civil e, por fim, concluiu-se pela necessidade de uma interpretação compatível com o atual contexto legislativo.With the advent of the Republic Constitution of 1988, it was instituted the Law Democratic State in Brazil. The RC/88 disciplines new precepts about the family and sets as fundamental the Human Being’s Dignity. Concerning this new legislative and state reality, the legislator of 2002, referring to dissolution of marriage, in the rights to family, keeps the need for guilt discussion, a matter that has been overcome by the jurisprudence. There is a trend for guilt disregard in the judicial separation. However, in the art. 1830 of the CC/02, the legislator innovated: it was brought a guilt presumption against of the deceased, when the dead spouse has separated for more than two years, hypothesis in which the survivor spouse becomes the heir. The aim of this paper was clearing up why the regression brought the mortuary guilt for the Civil Law, and, finally, it is necessary a compatible interpretation with the recent legislative context.
