Abstract
A presente dissertação volta-se para o estudo da devolução de crianças e adolescentes que foram adotadas. O objetivo geral da pesquisa é analisar a produção teórica sobre a devolução de crianças e adolescentes que foram adotadas no Brasil, a fim de identificar os fatores que influenciam na devolução, bem como os impactos causados. Especificamente, objetivou-se refletir sobre a condição da proteção integral, refletindo sobre a realidade brasileira e as legislações voltadas para proteção integral; buscou-se demonstrar as contradições da adoção e da devolução na realidade brasileira; e ainda, buscou-se analisar os artigos sobre a devolução de crianças e adolescentes que foram adotados a fim de desvendar as mediações desse fenômeno. Ancorado no método crítico dialético, a partir da análise temática de conteúdo, realizamos pesquisa bibliográfica a partir da base de dados da Scielo e do Google Acadêmico, totalizando 15 artigos para análise dos dados. Os resultados principais indicaram os principais motivos da devolução pelos pais e mães após a finalização da adoção; os principais impactos causados pela devolução à criança e ao adolescente; os perfis mais devolvidos; as principais formas utilizadas pelo judiciário para penalização dos pais e mães que devolvem; e a importância da construção de um programa/política de acompanhamento das famílias pós adoção no Brasil. Concluímos que trata-se de um fenômeno recente, desafiador e que precisa ser aprofundado pela sociedade com vistas a avançarmos no compromisso pela proteção integral de crianças e adolescentes no Brasil. This dissertation focuses on the study of the return of children and adolescents who were adopted. The general objective of the research is to analyze the theoretical production on the return of children and adolescents who were adopted in Brazil, in order to identify the factors that influence the return, as well as the impacts caused. Specifically, the objective was to reflect on the condition of full protection, reflecting on the Brazilian reality and the legislation aimed at full protection; we sought to demonstrate the contradictions of adoption and return in the Brazilian reality; and we also sought to analyze the articles on the return of children and adolescents who were adopted in order to unravel the mediations of this phenomenon. Anchored in the critical dialectical method, based on thematic content analysis, we conducted bibliographic research from the Scielo and Google Scholar databases, totaling 15 articles for data analysis. The main results indicated the main reasons for the return by the parents after the adoption was finalized; the main impacts caused by the return to the child and adolescent; the most returned profiles; the main methods used by the judiciary to punish parents who return children; and the importance of creating a program/policy to support post-adoption families in Brazil. We conclude that this is a recent and challenging phenomenon that needs to be studied in greater depth by society in order to advance our commitment to the comprehensive protection of children and adolescents in Brazil.
